Six Apart's Movable Type publishing software (the "Discontinued Software") are being made available to you for your own use pursuant to the terms and conditions of your pre-existing Movable Type license agreement, except that the Discontinued Software is made available on a strictly "as-is" basis, without any warranties of any kind and without any technical support.  By getting any version of the Discontinued Software, you represent and agree that:

*   You hold a valid, pre-existing license to use the version of the Discontinued Software that you are downloading.

*   You will use the Discontinued Software in compliance with your pre-existing license agreement.

*   Notwithstanding anything to the contrary in your pre-existing license agreement, the Discontinued Software is made available on a strictly "as-is" basis, without any warranties of any kind and without any technical support.

*   You acknowledge that the Discontinued Software may be subject to errors and security vulnerabilities which were discovered after Six Apart ceased maintaining the Discontinued Software.

*   Your use of the Discontinued Software is solely at your own risk and you will hold Six Apart harmless for any losses, claims or damages of any kind which may arise from such use.
